ADDENDUM:
Councillor Clissett submitted the petition in accordance with the Council’s established process for handling petitions and following advice provided by Staffordshire County Council officers at the time. This approach was considered appropriate because the petition related to concerns about a proposed development, rather than to a specific planning application that had already been submitted for formal determination by the Local Planning Authority. On that basis, it was reasonable for the petition to be accepted and presented through the County Council’s petition process.
Following the presentation of the petition to Full Council in May, the matter was reviewed further and the response from the relevant service area, Highways, was that the petition should be directed to Lichfield District Council for its consideration.
ORIGINAL RESPONSE:
Dear Councillor Clissett,
Thank you for presenting your petition at the Full Council meeting regarding the proposed development by Bloor Homes on Coulter Lane and Church Road, Burntwood.
Upon review, please note that planning applications for housing developments fall under the jurisdiction of the District Council in its capacity as the Local Planning Authority. As such, we would advise that the petition be directed to Lichfield District Council for their consideration.
As the Local Highway Authority, Staffordshire County Council’s role in relation to any application from the developer would be to respond to LDC as a consultee, and in doing so we might not propose any objections to an application subject to certain conditions/highway mitigation measures being imposed on the development, but ultimately, it would be for Lichfield District Council to decide whether they accept any suggested conditions proposed by the Highway Authority.
