Privacy Notice - Public Rights of Way
This privacy notice tells you what information the Staffordshire Rights of Way service collects and uses, along with explaining your rights regarding your personal information.
Lawful basis for processing personal data
Staffordshire County Council is the Highway Authority, the Surveying Authority and the Registration Authority for the purposes of maintaining public rights of way, maintaining the Definitive Map and Statement of Public Rights of Way and registration of common land and town or village greens. To carry out our legal obligations we are required to process personal data, and we abide by our obligations under the following legislation:
- Highways Act 1980
- Countryside and Rights of Way Act 2000
- Wildlife and Countryside Act 1981
- Road Traffic Regulation Act 1984
- Commons Act 2006
Our lawful basis for processing personal information for these purposes is as follows:
- UK GDPR Article 6, 1 (c) – compliance with a legal obligation
- UK GDPR Article 6, 1 (e) – the performance of a task carried out in the public interest
What personal data we collect
The categories of personal data that we collect and process as part of this service will include:
- Name, address, email address, and telephone numbers
- Information you provide as part of your engagement with this service, such as your use of a particular public right of way or area of land contained within consultation responses, objections or representations.
How we process your personal data
Staffordshire County Council, under our obligations for recording and altering the public rights of way network, will process your personal data to:
- Process applications to change the public rights of way network • Process Definitive Map Modification Orders
- Process Public Path Orders
- Respond to enquiries, requests for service and complaints
We do not use your personal data for commercial or marketing purposes, unless your prior explicit consent has been obtained.
What information we disclose
If you provide evidence or a response to a consultation relating to a definitive map modification order, traffic regulation order or a public path order, your personal details such as your name and your evidence and comments will be included in reports that will be used to determine if an order should be made. Such reports will be published on Staffordshire County Councils website. After an order has been made, anyone may ask to inspect copies of any documentation considered when deciding if an order should be made, these will include personal details.
If you submit a representation or objection to an order, this cannot be treated as confidential as we are required under our legal obligations to make details of public path and definitive map orders available for public inspection. If you apply, or submit evidence in relation to any of the following, your personal details will become a matter of public record:
- Definitive Map Modification Orders
- Public Path Orders
- Town and County Planning Act Orders
- User Evidence Forms or other statements to be used as such
- Town and Village Green applications
- Landowner deposits, statements and declarations
We have a statutory duty under the Highways Act 1980 section 31(6) to publish online registers of deposits and formal applications for definitive map modification orders. These documents are published and in the public domain and will contain personal data and anyone has the right to ask to view original documents.
If you apply for a definitive map modification order and believe that the publication of your details as the applicant may cause you substantial distress or damage, you may request that your personal details are removed from the register.
How long do we keep you information
We will keep your personal data in accordance with Staffordshire County Councils Record Retention Schedule and only for as long as necessary, the period in which we keep your information will therefore vary depending on what we are using it for.

Under data protection legislation, individuals have certain rights, such as a right to request access to information we may hold about you.
