Road status types

A road can have the following status:

  • Highway – A route where the public have a right to pass and repass without hindrance or charge. This does not always mean vehicles are allowed.
  • Non-highway – A route where the public have no right of access.
  • Permissive – Permission has been granted by the landowner for public use. This can be withdrawn at any time without notice.
  • Under construction – The route has not yet been built or is currently being constructed.

What is meant by 'maintenance status'?

The maintenance status (also known as 'adoption') refers to who is responsible for the upkeep or maintenance of a road. A road can have the following status:

  • Highways maintainable at public expense (HMPE) – Maintained by Staffordshire County Council as the local highway authority.
  • Prospectively HMPE – Will be maintained by us in the future, subject to specific conditions being met.
  • HMPE (Highways England) – Maintained by National Highways, such as motorways and trunk roads.
  • Not SCC Maintained or Private – Maintained by another body or individual. We do not hold records of whom this is.

How to check maintenance status

Use FindMyStreet. If the road is private, responsibility usually lies with the landowner. For landowner details, visit the Land Registry

Some roads under construction may be covered by a New Roads Agreement (Section 38, Highways Act 1980). To check if a road is covered, email road.adoptions@staffordshire.gov.uk.

As the local highway authority, we hold a list of streets as directed under Section 36(6) of the Highways Act 1980.
