Rail Crossing Extinguishment and Definitive Map and Statement Modification Order 2020 

This Order is made by Staffordshire County Council (“the authority") under section 118A of the Highways Act 1980 ("the 1980 Act"). 

Public Footpaths Cheslyn Hay No 22 and Great Wyrley No 26 in the authority's area described below crosses a railway otherwise than by a tunnel or bridge.

It appears to the authority that it is expedient in the interests of the safety of members of the public using, or likely to use, the said footpaths that they should be stopped up. 

South Staffordshire Council has been consulted as required by section 120(2) of the 1980 Act. 

Network Rail have agreed to defray any expenses which the authority may incur in connection with the erection and maintenance of barriers and signs.

This Order is also made under Section 53A(2) of the Wildlife & Countryside Act 1981 (“the 1981 Act”) because it appears to the authority that the Definitive Map and Statement for the District of South Staffordshire require modification in consequence of the occurrence of an event specified in Section 53(3)(a)(i) of the 1981 Act, namely the stopping up (as authorised by this Order) of a highway shown or required to be shown in the Map and Statement. 

This Order extinguishes the public right of way over the land situate between Westbourne Avenue, Cheslyn Hay and Quinton Drive, Great Wyrley shown by a continuous bold line on the map attached to this Order and described in Part 1 of the Schedule after 14 days from the date of confirmation of this Order, but where immediately before the date on which the footpath is diverted there is apparatus under, in, on, over, along or across it belonging to statutory undertakers for the purpose of carrying on their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had.

The full width of Public Footpath, Cheslyn Hay No 22 commencing at Westbourne Avenue at Grid Reference 398494 307283 (Point A on the Plan) and running in an easterly direction for a distance of approximately 30 metres to Grid Reference 398524 307288 (Point B on the Plan) 

Public Footpath, Great Wyrley No 26 

The full width of Public Footpath, Great Wyrley No 26 commencing at Grid Reference 398524 307288 (Point B on the Plan) and running across the railway and then running in a northerly then easterly direction around the back of properties situate on Quinton Avenue for a distance of approximately 109 metres to Grid Reference 398591 307321 (Point C on the Plan).
