Road Traffic Regulation Act 1984

The Staffordshire County Council (The County of Staffordshire, Prohibition and Restriction of Waiting and Loading and Parking Places) (Variation) Order 2022

Staffordshire County Council propose to make a Traffic Regulation Order under the Road Traffic Regulation Act 1984 to vary the provisions of the existing orders listed below by removing all references to the ‘Civil Enforcement of Parking Contraventions (England) General Regulations 2007’ and amend provisions set out in the affected orders to ensure these remain current. The affected orders are as follows:

  • The Staffordshire County Council (Newcastle-under-Lyme) (Prohibition and Restriction of Waiting and Loading and Parking Places) Order No 3
  • The Staffordshire County Council (Cannock Chase) (Civil Enforcement of Parking) (Prohibition and Restriction of Waiting and Loading and Parking Places) (Conversion) Order 2009
  • The Staffordshire County Council (East Staffordshire) (Prohibition and Restriction of Waiting and Loading and Parking Places) (Consolidation) Order 2020
  • The Staffordshire County Council (Lichfield) (Prohibition and Restriction of Waiting and Loading and Parking Places) (Consolidation) Order No 1/2009
  • The Staffordshire County Council (Stafford) (Prohibition and Restriction of Waiting and Loading and Parking Places) (Consolidation) Order 2018
  • The Staffordshire County Council (Staffordshire Moorlands) (Prohibition and Restriction of Waiting and Loading and Parking Places) Order No 2 (2009)
  • The Staffordshire County Council (Tamworth) (Prohibition and Restriction of Waiting and Loading and Parking Places) Order No 1
  • The Staffordshire County Council (South Staffordshire) (Prohibition and Restriction of Waiting and Loading and Parking Places) Order No 1

Road Traffic Regulation Act 1984

The Staffordshire County Council (The County of Staffordshire) (Prohibition and Restriction of Waiting and Loading and Parking Places Variation) Order 2022

 

The Staffordshire County Council in exercise of its powers under Sections 1, 2, 4, 32, 35, 45, 46, 47, 49, 53, 124(1)(d) and Part IV of Schedule 9 of the Road Traffic Regulation Act, 1984 ("the Act of 1984") as amended and the Traffic Management Act 2004 ("the 2004 Act") as amended and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act of 1984 hereby makes the following Traffic Regulation Order:-

 

  1. The orders listed in the schedule below are hereby affected and varied to the extent(s) and provisions provided in this order.
  2. The interpretation of “Penalty Charge Notice” will be removed and replaced by “means a notice issued by or served by a civil enforcement officer or posted by the enforcement authority pursuant to the regulations for the time being in force”.
  3. Under the provisions associated with “Manner of payment of penalty charge”, the reference “in accordance with the provisions of Section 21 of Part 5 of The Civil Enforcement of Parking Contraventions (England) General Regulations 2007” will be removed and be replaced by “pursuant to the provisions of the regulations for the time being in force”.
  4. Under the provisions associated with ‘Immobilisation’, the reference “section 12 of part 3 of The Civil Enforcement of Parking Contraventions (England) General Regulations 2007” will be removed and be replaced with “the regulations for the time being in force”.
  5. This Order shall come into operation on xx xxxx 20xx and may be cited as the The Staffordshire County Council (The County of Staffordshire) (Prohibition and Restriction of Waiting and Loading and Parking Places Variation) Order 2022.

Staffordshire County Council is proposing to vary the existing orders listed in the schedule below by removing all references to the ‘Civil Enforcement of Parking Contraventions (England) General Regulations 2007’, and to amend the provisions of those orders, to ensure that these remain current.
