(Zonal Prohibition of Heavy Commercial Vehicles over 7.5 tonnes Gross)

Order 20**

1.         Staffordshire County Council propose to make a Traffic Regulation Order under the Road Traffic Regulation Act 1984 to prohibit the use by any heavy commercial vehicle exceeding a maximum gross operating weight of 7.5 tonnes in the following zone:

The western boundary (roads included):

  • D3104 Chesterfield Road

The western boundary (roads not included):

  • A461 Sainte Foy Avenue, from the junction with Chesterfield Road to the junction with the A51 The Friary.
  • A51 The Friary, from the junction with the A461 Sainte Foy Avenue to the junction with the A51 Western Bypass.

The northern boundary (roads included):

  • C0353 The Friary, from the junction with the A51 Western Bypass to the junction with the C0352 St. John Street.
  • C0352 St. John Street, from the junction with the C0353 to the junction with the A5127 Birmingham Road.
  • A5127 Birmingham Road, Church Street, Trent Valley Road, from the junction with the C0352 St. John Street to the junction with the A5192 Cappers Lane.

The eastern boundary (roads not included):

  • A5192 Cappers Lane, from the junction with the A5127 Trent Valley Road to the junction with the C0066 Austin Cote Lane.
  • C0066 Austin Cote Lane, Ryknild Street from the junction with the A5192 Cappers Lane to the junction with the A51 Tamworth Road.

The southern boundary (roads not included):

  • A51 Tamworth Road from the junction with the C0066 Ryknild Street to the junction with the A51 Upper St. John Street.
  • A5206 London Road from the junction with the A51 Upper St. John Street to the junction with the Lichfield Southern Bypass.
  • Lichfield Southern Bypass from the junction with the A5206 London Road to the junction with the A461 Falkland Road.
  • A461 Falkland Road from the junction with the Lichfield Southern Bypass to the junction with the C0306 Claypit Lane.

2.         This Traffic Regulation Order will revoke the ‘County of Stafford (Shortbutts Lane, Lichfield and the Northern Residential Area) (Prohibition of Heavy Commercial Vehicles of Over 7.5 tonnes gross) Order, 1983’ and the ‘Staffordshire County Council (Various Roads in Lichfield) (Zonal Prohibition of Heavy Commercial Vehicles over 18 tonnes gross) Order 2015’ only in so far as they relate to this Order.

3.         Documents may be examined during office hours at 1 Staffordshire Place, Tipping Street, Stafford, ST16 2DH and during opening hours at Lichfield Library, The Guild of St Mary’s Centre, Market Square, Lichfield, Staffordshire.

4.         Objections should be sent in writing to: Strategic Asset and Network Management, Highways, 2 Staffordshire Place, Tipping Street, Stafford, ST16 2DH or to: trafficregulationorderobjections@staffordshire.gov.uk not later than 23 September 2021 quoting reference HoCPS/TM/TR14/21 and stating the grounds on which they are made.

Road Traffic Regulation Act 1984

Order 20**

The Staffordshire County Council ("the Council") in exercise of their powers under sections 1(1), 2(4) and 3(2) and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 ("the Act"), and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, hereby make the following Order:-

1.         This Order shall come into operation on the             20** and may be cited as the Staffordshire County Council (Various Roads in Lichfield) (Zonal Prohibition of Heavy Commercial Vehicles over 7.5 tonnes gross) Order 20**.

2.         In this Order, "heavy commercial vehicle" means a vehicle as defined in Section 138 of the Road Traffic Regulation Act, 1984.

3.         Save as provided in Article 4 of this Order no person shall, except upon the direction or with the permission of a police constable in uniform, use, cause, or permit any heavy commercial vehicle to proceed in any of the lengths of roads specified in the Schedule to this Order.

4.         Nothing in Article 3 of this Order shall render it unlawful for a heavy commercial vehicle to proceed on any length of road specified in the Schedule to this Order if the vehicle is being used:-

(a)       for or in connection with the conveyance of goods to or from any premises situated on or adjacent to that length of road;

(b)       for the purposes of agriculture on any land adjacent to that length of road or in connection with the conveyance or haulage of timber felled upon such land;

(c)       in connection with the carrying out, or on premises situated on or adjacent to that length of road, of any of the following operations, namely:-

(i)         building, industrial or demolition operations;

(ii)        the removal of any obstruction to traffic;

(iii)       the maintenance, improvement or reconstruction of the said lengths of road or side of road;

(iv)      the laying, erection, alteration or repair in, or in land adjacent to the said lengths of road or side of road of any sewer or any main, pipe or apparatus for the supply of gas or electricity or of any telegraphic line as defined in paragraph 1(1) of the Telecommunications Code contained in Schedule 2 of the Telecommunications Act 1984; any sewers and pipes or apparatus for the supply of water; or for resource mains and also any floods defence works or land drainage works.

(d)       for fire brigade, police or ambulance purposes;

(e)       to proceed to or from any premises which are situated on or adjacent to that length of road and at which the vehicle is to be, or has been, garaged, serviced or repaired;

(f)        in the service of a local authority or water undertaker or sewerage undertaker or the Environment Agency in pursuance of statutory powers or duties; or

(g)       on that road for or in connection with the conveyance of goods for sale from the vehicle; or

(h)       to gain access to premises situated on or adjacent to that length of road.

(i)        Buses, Coaches and other public service vehicles will be exempt.

5.         The Council are satisfied that for preserving or improving the amenities of the area through which lengths of road specified in the Schedule to this Order run by restricting the use on those roads of heavy commercial vehicles it is requisite that Section 3(1) of the Act of 1984 should not apply in relation to this Order.

6.         This Traffic Regulation Order will revoke the County of Stafford (Shortbutts Lane, Lichfield and the Northern Residential Area) (Prohibition of Heavy Commercial Vehicles of Over 7.5 tonnes gross) Order, 1983 and the Staffordshire County Council (Various Roads in Lichfield) (Zonal Prohibition of Heavy Commercial Vehicles over 18 tonnes gross) Order 2015 only in so far as they relate to this Order.

Statement of Reasons

This proposal forms part of the Staffordshire County Council’s commitment to the delivery of Integrated Transport Schemes within Staffordshire.

The scheme which has the support of the County Councillors whose constituencies are affected and Lichfield City Council, will look to provide an area wide environmental 7.5t weight restriction except for access on an area defined by those roads listed in the Schedule.

The introduction of these measures is for preventing the use of those roads by vehicular traffic of a kind which, or its use by vehicular traffic in a manner which, is unsuitable having regard to the existing character of the road or adjoining property. It is also to prevent damage or for preventing the likelihood of damage occurring to two railway structures within the designated weight limit zone.
