Planning and Enforcement Appeals

The Planning Inspectorate handle planning and enforcement appeals, employing independent Inspectors who act on behalf of the Secretary of State. The Planning Inspectorate use an on-line appeals system| (external link) available via the National Planning Portal to make appeals and to comment on or track the progress of appeals.

Planning appeals

Applicants are able to appeal to the Secretary of State for Communities and Local Government under Section 78 of the Town and Country Planning Act 1990| (external link)against the decision or the conditions attached to a planning permission within 6 months of the date of the decision.

To assist any person with an interest in making a planning appeal or making representations on a planning appeal, the Planning Inspectorate have published detailed guidance| (external link).

Enforcement appeals

Anyone with an interest in the land to which an enforcement notice relates or a relevant occupier may appeal to the Secretary of State for Communities and Local Government under Section 174 of the Town and Country Planning Act 1990| (external link) against the notice, whether or not a copy of it has been served on him. An appeal may be brought on various grounds (a) to (g) described in the Act.
