Waste planning in Staffordshire and Stoke-on-Trent

Staffordshire County Council and Stoke-on-Trent City Council, as Waste Planning Authorities, control the development of waste management facilities by determining planning applications submitted by waste operators in their areas.

In order to help determine planning applications Staffordshire and Stoke-on-Trent consider the applications against a number of waste planning policies and other relevant planning policies that are to be found in a series of documents, collectively referred to as the 'development plan'. Regional and Strategic Policy

The Staffordshire and Stoke-on-Trent Structure Plan 1996-2011, adopted in May 2001, contains strategic planning policies, including broad waste planning policies that the Waste Local Plan must conform with. The 'saved policies' in the Structure Plan, and the West Midlands Regional Spatial Strategy (June 2004), form a part of the development plan. For more information click on:

The Waste Local Plan: 'saved policies'

The Waste Local Plan (WLP) was adopted in February 2003.

A 'direction letter' from the Government c/o the Government Office for the West Midlands has confirmed the 'saved' policies in our WLP with effect from 28 September 2007. For more information click here.

The WLP is set out as follows:

  • Part 1: Introduction explains the purpose of the Plan;
  • Part 2: Background describes in more detail the context in which the Plan is being prepared;
  • Part 3: Waste Planning Strategy explains the principles that underpin the planning policies;
  • Part 4: General Policies (7) and Part 5: Specific Policies (9) contain the 'written statement' of policies;
  • The Proposals Map defines the Plan area;

A Glossary contains an explanation of the technical terms used in the Plan.

The General Policies are as follows:

  • Policy 1: General Considerations (not saved)
  • Policy 2: General Principles (not saved)
  • Policy 3: General Protection
  • Policy 4: Restoration, Aftercare and After-use
  • Policy 5: Legal Agreements
  • Policy 6: The Waste Implications of Major Development Proposals (not saved)
  • Policy 7: The siting of development in the vicinity of Waste Management Facilities (not saved)

The Specific Policies are as follows:

  • Policy 8: Landfill or Landraising (not saved)
  • Policy 9: Landfill Gas Utilisation
  • Policy 10: Waste Disposal on Agricultural, Forestry or Other Land
  • Policy 11: Re-working of deposited waste (not saved)
  • Policy 12: Criteria for the location of Waste Treatment Facilities
  • Policy 13: Time limits for Waste Treatment Facilities on Landfill and
  • Mineral Sites
  • Policy 14: Waste Treatment Facilities within buildings and in the open air
  • Policy 15: Temporary consent for open air waste treatment facilities
  • Policy 16: Incineration

A Code of Practice was prepared at the same time as the Waste Local Plan to provide an opportunity for comments to be made on it. The Code of Practice provides supplementary planning guidance to ensure that applicants are aware of the type of information that may need to be supplied when a planning application is being prepared for submission. Copies of the Code of Practice will be sent out with planning application forms.

Two technical appendices accompany the Waste Local Plan:

  • Technical Appendix 1: Waste Projections - explains the basic information that has been used to determine how much waste is likely to have to be managed in the plan area during the plan period.
  • Technical Appendix 2: Staffordshire and Stoke-on-Trent Waste Management Facilities lists the existing waste management facilities in the plan area.

Two additional documents were produced in accordance with the relevant regulations when the Draft Waste Local Plan was placed on deposit.

  • A Sustainability Appraisal, which considers the plan policies against environmental and sustainable development criteria.
  • And, a Statement of Publicity, which describes the steps that have been taken to publicise the preparation of the Plan and the opportunities that have been given to comment on the principles and policies.

Timetable for review

The Waste Local Plan was adopted in February 2003. The aim is to review the Plan in accordance with the timetable set out on the Minerals and Waste Development Scheme. For more details go to:
