Appeals

Applicants are able to appeal to the Secretary of State for Communities and Local Government under Section 78 of the Town and Country Planning Act 1990 against the decision or the conditions attached to a planning permission within 6 months of the date of the decision.

The Planning Inspectorate handle appeals employing independent Inspectors, who act on behalf of the Secretary of State. 

To assist any person with an interest in an appeal, the Planning Inspectorate has produced two guidance notes:

The Public Inquiry is due to open at 10 am on 16 December 2008 and is expected to last for 2 days. The venue will be Essington Community Centre, Hobnock Road, Essington WV11 2RF.

Please note: 

The public inquiry opened on 3 June 2008 and adjourned on 4 June 2008.  The inquiry resumed on 22 July 2008 at The Coton Centre, Comberford Road, Tamworth B79 9AA (tel. 01827 60789) and closed the same day.  A decision is now awaited
